Perspectives Health (“Perspectives,” “we,” “us,” or “our”) provides software and technology services to healthcare organizations. This Privacy Policy explains how we collect, use, and disclose personal information in connection with our websites, applications, browser extension, and related services (collectively, the “Services”).

Applicability

This Privacy Policy applies to personal information that Perspectives collects in connection with our business and the Services.

This Privacy Policy does not apply to information that our healthcare customers and their authorized users provide to or process through the Services on their behalf (“Customer Data”). Customer Data may include clinical information, patient and chart information, information from electronic medical records (“EMRs”), audio recordings, transcripts, and other protected health information (“PHI”).

We process Customer Data on behalf of our healthcare customers and in accordance with our agreements with those customers, including applicable Business Associate Agreements (“BAAs”).

If you are a patient whose healthcare provider uses Perspectives, questions or requests concerning your health information should generally be directed to your healthcare provider. Please refer to your healthcare provider’s Notice of Privacy Practices for information about its privacy practices and your rights with respect to your health information.

1. Information We Collect

Depending on how you interact with Perspectives, we may collect:

Information you provide to us. This may include your name, email address, organization, account information, and other information you provide when you create an account, contact us, request support, or otherwise interact with Perspectives.

Information collected through the Services. We may collect technical and usage information necessary to operate, secure, maintain, and troubleshoot the Services, such as device and browser information, application logs, error information, and information about interactions with the Services.

Customer Data. When authorized users use the Services on behalf of a healthcare organization, Perspectives may process Customer Data, including clinical and chart information, EMR data, form data, audio recordings, transcripts, and other information necessary to provide the Services. As described above, our processing of Customer Data is governed by our agreements with the applicable healthcare organization.

2. How We Use Information

We may use personal information to:

Customer Data is used to provide the Services requested by our healthcare customers, including supporting clinical documentation, transcription, clinical and operational workflows, EMR workflows, reporting, and related functionality.

We do not use personal information or Customer Data for targeted or behavioral advertising.

3. How We Disclose Information

We may disclose personal information in the following circumstances:

Service Providers. We may disclose information to vendors and service providers that perform services on our behalf, such as cloud hosting, infrastructure, data processing, transcription, artificial intelligence, security, and other technology services. These providers may process information only as necessary to provide services to Perspectives and are subject to appropriate contractual obligations.

Where a service provider creates, receives, maintains, or transmits PHI on our behalf, we enter into a BAA where required by HIPAA.

Healthcare Customers. Information processed through the Services may be made available to the healthcare organization and its authorized users for whom the Services are being provided.

Legal and Safety Purposes. We may disclose information if required by law or legal process, or where reasonably necessary to protect the rights, safety, or security of Perspectives, our customers, users, or others.

Business Transactions. Information may be disclosed in connection with an actual or proposed merger, acquisition, financing, reorganization, sale of assets, or similar business transaction, subject to applicable legal and contractual requirements.

We do not sell personal information or PHI. We do not disclose personal information or PHI to third parties for targeted or behavioral advertising.

4. Healthcare Data and HIPAA

Perspectives provides Services to healthcare organizations and may act as a business associate under HIPAA when we create, receive, maintain, or transmit PHI on their behalf.

When we act as a business associate, our use and disclosure of PHI is governed by HIPAA and our agreement with the applicable healthcare organization, including our BAA. We use and disclose PHI only as permitted by those agreements and applicable law.

Healthcare organizations are responsible for their relationships with their patients and for responding to requests from patients concerning their health information. We assist our healthcare customers in fulfilling their obligations as required by our agreements and applicable law.

5. Data Security

We maintain administrative, technical, and organizational safeguards designed to protect personal information and Customer Data in accordance with applicable legal and contractual requirements.

Access to Customer Data is limited to authorized users and personnel who require access to provide, support, secure, or maintain the Services.

6. Data Retention

We retain personal information for as long as we have a legitimate business need to do so, including to provide the Services and comply with applicable legal obligations. When we no longer have a legitimate need to retain personal information, we delete it or take appropriate steps to prevent further use.

Information that we process on behalf of healthcare organizations, including PHI, is retained in accordance with our agreements with those organizations and applicable law.

7. Browser Extension

Our browser extension processes information as necessary to provide its disclosed functionality, including supporting clinical documentation and healthcare workflows within supported systems.

Depending on the features used, this may include Customer Data such as clinical and chart information, information displayed in supported EMRs, form data, audio recordings, and transcripts.

We do not sell information collected through the browser extension or use it for targeted or behavioral advertising. Information processed through the extension may be transferred to service providers as necessary to provide the Services and subject to the protections described in this Privacy Policy and our agreements with healthcare customers.

Our use of information obtained through the browser extension is subject to the Chrome Web Store User Data Policy, including its Limited Use requirements.

8. Privacy Rights

Depending on where you live and subject to applicable law, you may have rights regarding your personal information, such as the right to request access to, correction of, or deletion of certain personal information.

If your request concerns health information that Perspectives processes as Customer Data on behalf of a healthcare organization, you should contact the healthcare organization directly. We will assist our healthcare customers with requests concerning Customer Data as required by our agreements and applicable law.

9. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes to our Services, practices, or legal obligations. When we make changes, we will update the “Last Updated” date at the top of this Privacy Policy.
